Oregon Plastic Pollution and Recycling Modernization Act
Oregon Plastic Pollution and Recycling Modernization Act is SB 582 of 2021, the Oregon law that made producers of packaging, paper and food service ware fund a statewide recycling system starting July 2025.
What it requires
Producers must join a producer responsibility organization, currently Circular Action Alliance, report the weight of covered products sold into Oregon, and pay fees, which began on 1 July 2025 and vary by material. Small producers with under 5 million dollars in gross revenue or under one metric ton of covered products in Oregon are exempt. The 25 largest producers must also run life cycle evaluations on some products. DEQ can assess civil penalties for producers that do not comply.
Why it matters
Oregon is the first US state where packaging EPR fees are actually being paid, so it is the practical test case for e-commerce brands. Fees apply to shipping cartons, mailers and void fill as well as product packaging, which makes warehouse packaging data a compliance input. For example, a brand selling online with more than 5 million dollars in global revenue that ships to Oregon customers must register with Circular Action Alliance and pay fees on those shipments, even if every order leaves a warehouse in another state.
