New York Warehouse Worker Protection Act

New York Warehouse Worker Protection Act is the New York law, signed in December 2022 and effective June 2023, that requires large warehouse employers to disclose quotas and, since a 2024 amendment, run injury reduction programs.

2022, effective 2023 US state New York Enforced by New York State DOL N.Y. Labor Law 780 et seq.

What it requires

It covers employers with 100 or more employees at one warehouse distribution center or 1,000 statewide, counting workers supplied through staffing agencies. Employers must provide written quota descriptions at hire and on changes, share work speed data on request, and not set quotas that prevent breaks. The 2024 amendment, effective in 2025, requires an injury reduction program with a qualified ergonomist evaluating worksites for musculoskeletal risks, training, and employee involvement. The Department of Labor and Attorney General enforce it.

Why it matters

New York goes beyond quota disclosure by requiring an ergonomics program, so covered fulfillment centers need a documented injury reduction process. Ergonomic evaluations must consider work pace, which links productivity targets directly to safety review. For example, a 3PL with 150 workers at a Long Island fulfillment center must have a qualified ergonomist evaluate repetitive lifting at pack stations, adjust workstations or rates where risk is found, and involve workers in the process each year.
