De Minimis

De Minimis is a value threshold below which imported shipments could enter duty-free with simplified entry. US Section 321 set this at $800 per person per day.

Topic: Import & Customs Entry IMP-069

Why it matters for ecommerce brands

The US suspended de minimis for commercial shipments from all countries on August 29, 2025 (Executive Order 14324). CBP made the suspension part of its regulations in June 2026, and the One Big Beautiful Bill Act ends the exemption by statute on July 1, 2027. Low-value DTC imports now need formal or informal entry and pay duties, so cross-border models built on Section 321 need new duty planning.

Common questions

Is the $800 de minimis exemption still available for US imports?
No. The Section 321 de minimis exemption was suspended for all countries effective August 29, 2025, under Executive Order 14324, and CBP codified the suspension by rule in June 2026. The One Big Beautiful Bill Act terminates it in statute as of July 1, 2027, so low-value shipments now need a formal or informal entry and pay applicable duties.
